Анотація
Стаття приділена питанням дослідження доктринальних аспектів розширення предмету кримінології у контексті кримінальних правопорушень у сфері обігу наркотичних засобів з залученням неповнолітніх осіб. Наголошено, що кримінологія становить систему знань соціально-юридичного та політичного характеру про злочинність та її прояви, причини й умови, а також діяльність у сфері профілактики та протидії кримінальним правопорушенням. Предмет кримінології утворюють чотири елементи: злочинність, причини та умови злочинності, особа злочинця, запобігання злочинності. Підкреслено, що предмет може бути представлений як поєднання загальної та особливої частини. Розширення предмету кримінології відповідає поступальному суспільному розвитку та прогресу соціальних і гуманітарних наук та соціально-економічним особливостям розвитку суспільства. На особливу увагу заслуговує міжнародний напрям у кримінологічній науці та увага до таких злочинів міжнародно-правового характеру як незаконний обіг наркотичних засобів з залученням неповнолітніх осіб. Важливою частиною предмета кримінологічних досліджень сьогодні виступає такий новий напрямок у вітчизняних науках кримінального циклу, як аналіз детермінантів та способів залучення неповнолітніх до вчинення кримінальних правопорушень у сфері наркотичних засобів, у тому числі контрабанди наркотичних засобів та незаконного збуту наркотичних засобів в мережі Інтернет. На особливу увагу при цьому має заслуговувати прихована реклама збуту наркотичних засобів в Інтернеті, спрямована на уникнення контролю як з боку провайдерів так і правоохоронних органів. Важливою частиною предмета кримінологічних досліджень виступає такий новий напрям у вітчизняних науках кримінального циклу, як порівняльна та міжнародна кримінологія. Запропоновано доповнити ч. 2 диспозиції ст. 305 КК України «Контрабанда наркотичних засобів, психотропних речовин, їх аналогів чи прекурсорів або фальсифікованих лікарських засобів» словами «…або з залученням неповнолітньої особи…».
The paper is dedicated to issues on research of doctrinal aspects of deployment of the subject of the criminology in the context of criminal offences in the field of drug traffic with involvement of minors. There is emphasized, the criminology is a system of sociological and legal and political knowledge about criminality and its manifestations, causes and conditions, and activities in the field of prevention and counteraction to criminal offences. The subject of the criminology is created by four components. They are criminality, causes and conditions of the criminality, person of the criminal, and prevention to the criminality. There is outlined, the subject can be represented as a composition of the general and specific parts. Deployment of the subject of the criminology corresponds to the progressive social development and to the progress of social and humanitarian sciences, and to the social and economic peculiarities of development of the society. The certain attention should be paid to the international direction in the criminological science and to such crimes of the international-legal character as illegal drug traffic with the involvement of minors. Today, the important part of the subject of criminological researches is a such new direction of domestic sciences of the criminal cycle, as the analysis of determinants and methods of involvement of minors into committing criminal offenses in the field of narcotics, including smuggling of drugs and illegal sale of drugs on the Internet. Especial attention should be paid to hidden advertising of the sale of drugs on the Internet. This advertising is aimed to avoiding control of both providers and law enforcement authorities. The comparative criminology and the international criminology are important part of the subject of the criminological researches. There is suggested to supplement Part 2 of the disposition of Art. 305 of the Criminal Code of Ukraine “Smuggling of narcotic drugs, psychotropic
