Анотація
Стаття приділена питанням дослідження доктринальних аспектів розширення предмету кримінології у контексті російсько-україн-
ської війни. Наголошено, що кримінологія становить систему знань соціально-юридичного та політичного характеру про злочинність
та її прояви, причини й умови, а також діяльність у сфері профілактики та протидії кримінальним правопорушенням. Предмет кримінології утворюють чотири елементи: злочинність, причини та умови злочинності, особа злочинця, запобігання злочинності. Підкреслено, що предмет може бути представлений як поєднання загальної та особливої частини. Розширення предмету кримінології відповідає поступальному суспільному розвитку та прогресу соціальних і гуманітарних наук та реаліям соціально-політичної боротьби українського народу з російськими загарбниками. Російсько-українська війна обумовлює необхідність виокремлення в якості тематичних напрямів особливої частини кримінологічного дослідження кримінальних правопорушень у сфері миру, безпеки людства та міжнародного правопорядку, а також злочинів проти основ національної безпеки України. Йдеться про нагальність привернення уваги до питань поняття, ознак, генезису, детермінант та фонових явищ таких злочинів, як: планування, підготовка, розв’язування та ведення агресивної війни; порушення законів та звичаїв війни; виправдовування, визнання правомірною, заперечення збройної агресії Російської Федерації проти України, глорифікація її учасників; колабораційна діяльність; пособництво державі-агресору; несанкціоноване поширення інформації про направлення та переміщення зброї, озброєння і бойових припасів в Україну, рух, переміщення або розміщення Збройних Сил України чи інших утворених відповідно до законів України військових формувань, вчинене в умовах воєнного або надзвичайного стану. Також на особливу увагу заслуговує міжнародний напрям у кримінологічній науці та увага до конвенційних злочинів, таких як екоцид та геноцид. Важливою частиною предмета кримінологічних досліджень виступає такий новий напрям у вітчизняних науках кримінального циклу, як порівняльна та міжнародна кримінологія.
The paper is dedicated to issues on researching doctrinal aspects of spreading a subject of Criminology Science in the context of the Russian- Ukrainian war. There is stressed, Criminology is a system of knowledge of social-legal and politic character about crime and its manifestations, reasons and conditions, and activities in the field of the prevention and counteraction of criminal offences. Four components are included in the subject of Criminology. They are crime, reasons and conditions of the crime, a person of the criminal, and prevention of the crime. There is outlined, the subject can be represented as a composition of general and specific parts. Spreading of the subject of Criminology corresponds with progressive social development and progress of social and humanitarian sciences, and reality of the social and politic struggle of the Ukrainian people with the Russian invaders. The Russian-Ukrainian war causes a necessity of selection of criminal offences in the field of the peace, humanity safety, international legal order, and crimes against the foundations of national security of Ukraine as certain thematic directions of the specific part of the Criminology Science. We are talking about urgency of focusing attention on the issue of the concept, features, genesis, determinants, and background of such crimes as planning, preparation, unleashing and conducting an aggressive war; violation of the laws and customs of war; justification, recognizing as legitimate, denial of armed aggression of the Russian Federation against Ukraine, and glorification of its participants; collaborative activities; assistance to the aggressor state; unauthorized dissemination of information about the sending and movement of weapons, armaments and military supplies to Ukraine, the movement, movement or deployment of the Armed Forces of Ukraine or other military formations formed in accordance with the laws of Ukraine, committed under conditions of war or a state of emergency. However, it is necessary to pay especial attention to international direction in Criminology Science and to crimes, provided by Conventions, such as ecocide and genocide. Such a new direction in domestic sciences of criminal cycle as Comparative Criminology is a significant part of the subject of criminology researches.
